29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following:    1.  Labels and other forms of warning as specified in paragraph 29 CFR 1910.1200(f) 2.  Safety data Sheets as specified in paragraph 29 CFR 1910.1200(g) 3.  Employee information and training as specified in paragraph 29 CFR 1910.1200(h)  Northside, Welding Area:  On or about November 18, 2020, employees were exposed to welding fumes, lead, Iron (III) oxide, and hexavalent chromium.  The employer did not develop or implement a written hazard communication program that include the above mentioned elements.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR  1910.1200(h)(1):Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.  Northside, Welding Area:  On or about December 9, 2020, employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area.  Employees are welding on stainless steel daily and are exposed to chemicals such as but not limited to hexavalent chromium, copper fume and iron oxide.  Abatement documentation is required of this item in accordance with 29 CFR 1903.19(d).

29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:     Northside, Welding Area:  On or about November 18, 2020, Julio Gaytan and Felipe Camargo were required to wear 3M N95 during the welding of galvanneal material.  The employer, T/J Fabricators, Inc., did not develop and implement a written respiratory protection program.  Employees are exposed to iron oxide and copper fume.  Abatement documentation is required of this item in accordance with the requirements of 29 CFR 1903.19(d).
