29 CFR 1926.501(a)(2): Employees were allowed to work on surfaces which did not have the requisite strength and structural integrity. Location: a) On the balcony of 2nd floor northwest side of the jobsite: On or about October 19, 2020, an employee stepped on a wood guardrail while installing coverings for the building fa�ade. The guardrail broke, and he fell approximately 12.5 feet from the top of the guardrail to the ground level.

The ladder was not designed to be used for this purpose.

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways. Location: a) On the balcony of 2nd floor northwest side of the jobsite: On or about October 19, 2020, the employer did not provide training to an employee who used a portable stepladder to install covering for the building fa�ade. The employee was exposed to fall hazards due to a ladder tip over from sideloading.
