29 CFR  1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  (a)  CPC Services LLC, at 9526 Quintero Street, Commerce City, CO:  On and preceding 10/21/2020, CPC Services LLC did not develop, implement, and/or maintain at the workplace a written hazard communication program.   Chemicals found in the workplace to which employees were exposed included, but were not limited, to the following:  1.  James Hardie Building Products HardiePlank Exterior Fiber-Cement (containing 15-45% crystalline silica).   Employees cut the product with a circular saw, which exposed the employees to airborne crystalline silica, a chemical hazard.

Chemicals found in the workplace for which the employer did not have an SDS included, but were not limited, to the following:  1.  James Hardie Building Products HardiePlank Exterior Fiber-Cement (containing 15-45% crystalline silica).   Employees cut the product with a circular saw, which exposed the employees to airborne crystalline silica, a chemical hazard.

29 CFR  1910.1200(h)(3)(iv):   Employee training did not include the details of the hazard communication program developed by the employer, including an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information:  (a)  CPC Services LLC, at 9526 Quintero Street, Commerce City, CO:  On and preceding 10/21/2020, CPC Services LLC did not ensure that employee training included the details of the hazard communication program developed by the employer, including an explanation of the safety data sheet, including the order of information and how employees can obtain and use the appropriate hazard information.   Chemicals, including but not limited to James Hardie Building Products HardiePlank Exterior Fiber-Cement (containing 15-45% crystalline silica), were used by employees or present in the workplace. 29 CFR  1926.454(b): The employer did not have each employee involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question:   (a)  CPC Services LLC, at 9526 Quintero Street, Commerce City, CO:  On and preceding 10/21/2020, CPC Services LLC did not have each employee involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question.  Two employees erected an Alum-A-Pole Pro Jack pump jack scaffold.  The employees were not provided training.  The scaffold had been erected without a mid-rail and without end rails.  This condition exposed employees to a scaffold hazard.

Two employees removed siding from and installed siding to a two story home.  Employees performed this work while standing upon the first story roof.  The employees had not been provided fall protection training.  This condition exposed employees to an approximate ten foot fall hazard.

The employer did not evaluate employee exposure to respirable crystalline silica.  This condition exposed the employees to a respirable crystalline silica hazard.
