29 CFR 1910.147(c)(4)(i):Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: a. Arps Dairy, Inc. - Defiance, Ohio: On or about October 15, 2020, the employer did not develop, document, and utilize energy control procedures for the Half-Pint Machine (s/n 2459). Employees that unjam and clean the machine were exposed to injury in that energy control was not utilized for the servicing and maintenance tasks. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1910.147(d):The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6): a. Arps Dairy, Inc. - Defiance, Ohio: On or about October 15, 2020, employees were exposed to pinch point and rotating part hazards in that the Half-Pint machine (s/n 2459) was not locked out prior to unjamming cartons from the chain conveyor. The employer did not ensure that energy control application steps were implemented to control the machine's electrical/mechanical energy sources prior to the servicing task; the employer did not: - Turn off or shut down the equipment. - Physically operate energy isolating devices to control energy sources and affix lockout device(s). - Ensure that all potentially hazardous stored or residual energy was relieved, disconnected, and rendered safe. - Verify that isolation and deenergization of the machine or equipment had been accomplished. b. Arps Dairy, Inc. - Defiance, Ohio: On or about November 23, 2020, employees were exposed to pinch point and rotating part hazards in that the Half-Pint machine (s/n 2459) was not locked out prior to cleaning the machine. The employer did not ensure that energy control application steps were implemented to control the machine's electrical/mechanical energy sources prior to the servicing task; the employer did not: - Ensure employees had the method or means to control hazardous energy. - Physically operate energy isolating devices to control energy sources and affix lockout device(s). - Ensure that all potentially hazardous stored or residual energy was relieved, disconnected, and rendered safe. - Verify that isolation and deenergization of the machine or equipment had been accomplished. Arps Dairy, Inc. - Defiance, Ohio: On or about October 15, 2020, employees who operated the Half-Pint machine (s/n 2459) were exposed to caught-by hazards in that the rotating parts created by the machine's carton feeder, located at the load side of the machine, were not guarded. b. Arps Dairy, Inc. - Defiance, Ohio: On or about October 15, 2020, employees who operated the Half-Pint machine (s/n 2459) were exposed caught between hazards in that the pinch points created by the machine's reciprocating carton former were not guarded. c. Arps Dairy, Inc. - Defiance, Ohio: On or about October 15, 2020, employees who operated the Half-Pint machine (s/n 2459) were exposed to caught-in hazards in that the rotating parts located at the discharge end of the chain conveyor were not guarded. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
