29 CFR 1910.28(b)(1)(i):  Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):  On or about December 5, 2024 and at times thereafter, in the tank cleaning area the employer did not ensure employees accessing the top of tanker trucks during tank cleaning processes were protected from falling approximately 12 feet to the concrete floor below by a guardrail system, safety net system or personal fall protection system.

29 CFR 1910.95(g)(1): The employer did not establish and maintain an audiometric testing program as provided by 29 CFR 1910.95(g) by making audiometric testing available to all employees whose exposures equal or exceed an 8-hour time-weighted average of 85 decibels or a dose of fifty percent:  On or about January 18, 2024, the employer did not establish an audiometric testing program for all employees exposed to noise levels above an 8-hour time weighted average of 85 dBA while working in the processing areas of the plant. Noise dosimetry showed:  a) An employee operating the jug line was exposed to noise at 77.7% of the permissible daily dose as measured over 573 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 86.8 dBA which exceeds the adjusted action limit of 83.7 dBA.   b) An employee working on the jug line was exposed to noise at 65.3% of the permissible daily dose as measured over 591 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 83.5 dBA which equals the adjusted action limit of 83.5 dBA.  c) An employee working on the liquifier and jug line was exposed to noise at 50.7% of the daily permissible daily dose as measured over 515 minutes of sampling. This dose is equivalent to an 8-hour TWA exposure of 84.5 dBA which equals the adjusted action limit of 84.5 dBA.  d) An additional five employees working on the half pint line and in HTST Processing had projected 8-hour TWAs ranging from 86.0 dBA to 87.8 dBA which exceeds the action limit of 85.0 dBA.

29 CFR 1910.147(c)(6)(i): The employer did not conduct an annual or more frequent inspection of the energy control procedure to ensure that the procedure and requirements of this standard were followed:  On or about December 6, 2023, the employer did not ensure periodic inspections of the energy control procedures were completed at last annually.   a) Employees working on the half pint line are required to attach the CIP system during sanitation, and clear jams in the machine during production which requires energy control procedures that have not been reviewed for deficiencies thereby exposing employees to pinch point and rotating part hazards.  b)  Employees working on the jug line are required to attach the CIP system during sanitation, and clear jams in the machine during production which requires energy control procedures that have not been reviewed for deficiencies thereby exposing employees to pinch point and rotating part hazards.

29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):   a) On or about December 6, 2023, the employer did not ensure that the company's energy control procedures were utilized to control hazardous mechanical movement of the carton conveyors in the half pint machine when employees attached CIP trays and piping for sanitation and when clearing jams during production exposing employees to pinch point and rotating part hazards.   b) On or about December 6, 2023, the employer did not ensure that the company energy control procedures were utilized to control hazardous mechanical movement of the rotating platforms on the jug filling machine when employees perform sanitation procedures and when cleaning jams in the machine during production exposing employees to pinch point hazards and rotating part hazards.

29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):   On or about December 6, 2023, the employer had not developed a written hazard communication program for employees exposed to hazardous chemicals such as, but not limited to sodium carbonate, benzenesulfonic acid, potassium hydroxide, sodium hypochlorite, sodium chloride, acetic acid, hydrogen peroxide and peracetic acid which are included in Divosan Plus, Interest, and Diton B. Employees were exposed to contact hazards which could result in health effect such as burns to the skin and eyes.
