29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that gate guards were exposed to struck-by hazards while manually opening a gate across a railroad track:  a) Jobsite located approximately at West 10th Street & Rennie Lane; North side gate of Energy Transfer facility, Marcus Hook Terminal- On or about October 20, 2020 a gate guard was required to manually open a gate across a railroad track while a moving train was coming towards the crossing exposing the employees to the hazard of being struck by a train.
