29 CFR 1910.119(f)(1): The employer did not develop and implement written operating procedures that provided clear instructions for safely conducting activities involved in each covered process consistent with the process safety information addressing at least the elements listed in 1910.119(f)(1)(i)(A)-1910.119(f)(1)(iv):  CP-4 Engine Room:  On or about October 20, 2020, the employer failed to develop and implement clear instructions for safely conducting activities involved in each covered process consistent with the process safety information.  The High Stage Compressor C6 (K12828) SOP, Revision #7, was deficient in that the instructions were inaccurate. In particular, the following were examined:  a) deleted b) The SOP procedural steps 8 identify the need to verify that the manual valves are open, however these valves do not exist.  The SOP procedural steps instruct employees to verify valve conditions, to open, close, or shut valves. Because of this reason, valves must be clearly marked and matched with each other between the SOP, the P&ID, and the physical layout to avoid confusion. Employees and contractors must immediately know what valves to open and close. Employees engaged in operating, inspecting, testing, and maintaining activities at the covered process equipment in the CP-4 engine rooms were exposed to catastrophic release of ammonia which results in asphyxiation, explosion and flash fire leading to death and injury to persons in and near the facility.  29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.

29 CFR  1910.119(d)(3)(i)(B):The employer's piping and instrument diagrams (P&IDs) were not accurate and did not represent equipment that was existing and was part of the process:  Compressor # 6 - On or about October 20, 2020, the employer failed to verify that all P&IDs were up to date and accurate for use by Schwan employees and contractors for the process hazard analysis, line breaks, equipment and piping replacement or repairs, and etc.  Employees engaged in operating, inspecting, testing, and maintaining activities at the covered process equipment by the Compressor #6 of the CP-4 engine room were exposed to chemical hazards associated with a catastrophic release of ammonia. During the walk around, CSHO field verified the P&ID Drawing #R8017 with the actual as-built field layout of the Compressor #6, and observed following deficiencies:  a) One (1) valve labeled HV14 KT12828 was observed to be in the wrong physical location when compared to the P&ID. The HV14 valve ID tag labeled next to HV39, but was found on the other side. It is supposed to be located by HV12, HV13, and GA03.   b) Six (6) valves labeled HV24, HV26, HV28, HV30, HV32, and HV34 on the P&ID did not match with the label on the piping portal. They were drawn on the P&ID, but could not located in the field physical location layout. These six hand-valves should not be seen on the P&ID drawing.   c), d) e) Deleted  29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.  The Schwan's Global Supply Chain Inc. was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard 29 CFR 1910.119(d)(3)(i)(B), which was contained in OSHA inspection number 1213761, citation number 1, item number 2 and was affirmed as a final order on 9/14/2017, with respect to a workplace located at 3019 Scanlan Avenue Salina, KS 67401.

29 CFR  1910.119(d)(3)(ii): The employer did not document that equipment complies with recognized and generally accepted good engineering practices:  A. On or about October 20, 2020, the employer failed to document that equipment complied with employer's chosen RAGAGEP such as but not limited to  including ASHRAE Standard 15-2007 (Safety Code for Mechanical Refrigeration), when the employer did not ensure ammonia refrigeration valves were marked/labeled. Employees engaged in repairing, replacing, operating, inspecting, testing, and maintaining activities of covered process equipment at the engine rooms were exposed to the hazards of inhalation of toxic Ammonia, asphyxiation, chemical burns, and fire.  The following was noted during the walk around:  CP-2 Engine Room: (a) Four (4) valves were missing the valve Identification Tags for the Evaporator B10258 located by HV05. CP-4 Engine Room: (a) One (1) valve was missing the valve Identification Tag located by the Intercooler just above the 2 Pressure Relief Valves V15781/TW01 V15781/PRV01 & PRV02. (b) One (1) valve was missing the valve Identification Tag located by the South Intercooler pump P14822. (c) Two (2) valves were missing the valve Identification Tags located next to these valves V15775/MEV01. (d) Five (5) valves were missing the valve Identification Tags located by the Compressor #6 labeled K12828 GA03; BPR02; HV11; PT03; and HV18.  B. and C. Deleted  29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete. 29 CFR  1910.147(c)(5)(ii)(A)(2): Tagout devices were not printed so that exposure to wet and damp locations would not cause the message on the tag to become illegible:  Employees engaged in repairing, replacing, operating, inspecting, testing, and maintaining activities of covered process equipment at the engine rooms were exposed to electrical, struck-by and caught-between hazards in that the tagout devices were deteriorated, faded and the message on the tag was illegible by the Intercooler vessel right outside of CP2 with reference to the following hand valves: HV10, HV11, V15788.  29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete. 29 CFR  1910.147(c)(5)(ii)(D): Lockout devices and tagout devices did not indicate the identity of the employee applying the device(s):  Employees engaged in repairing, replacing, operating, inspecting, testing, and maintaining activities of covered process equipment at the engine rooms were exposed to electrical, struck-by and caught-between hazards in that the tagout devices did not indicate the identity of the employee applying the devices. The following was noted during the walk around: (a) CP2 CREPACO Compressor #8 with reference to the hand valve HV01 K12767/C8, HV02 K12767/C8, and HV12 K12767/C8, a tagout device to isolate the compressor was observed not having any identity, date, department, remarks, reasons for applying the tag. (b) CP2 K12767 TOMCC-915-22-01, a tagout device to isolate the compressor was observed not having any identity. (c) CP2 Exhaust Fan over Small Compressor Room, TOMCC-916-12-01 VEX-108, jacket pump #1, a tagout device to isolate the compressor was observed not having any identity. (d) CP2 Fed From TODP-916-07, 480V, a tagout device to isolate the compressor was observed not having any identity.  29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is complete.
