29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a. On or about October 22, 2020, and at times prior, employees were operating pneumatic nail guns without eye protection, thereby exposed to a struck-by hazard.  Fernando Alvarado was previously cited for a Serious violation of this Occupational Safety and Health Standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 1427905, citation number 1, item number 1 and was affirmed as a final order on November 21, 2019, with respect to a workplace located at 12301 Greenwood Drive, Pickerington, Ohio.

29 CFR  1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a. Located at 3635 Mystic Way, Grove City, OH 43123: On or about October 22, 2020, where employees utilized an extension ladder to gain access to the second story of a residential structure, the ladder did not extend at least 3 feet above the landing surface, thereby exposing employees to a 10 foot 8 inch fall hazard.  Fernando Alvarado was previously cited for a Serious violation of this Occupational Safety and Health Standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1406433, citation number 1, item number 4 and was affirmed as a final order on October 11, 2019, with respect to a workplace located at Lot 46, 5377 Bulleit Drive, Westerville, Ohio.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Located at 3625 Mystic Way, Grove City, OH 43123:  a. On or about October 22, 2020, an employee was installing sheeting on the roof of the garage trusses of the one-story residential structure being built. The employee had a harness on but no fall protection measures in place or in use. As a result, the employee was exposed to falls from heights of approximately 10 foot - 8 inches.   b. On or about October 22, 2020, an employee was installing sheeting on the trusses on the backside of one-story residential structure being built. The employee had a harness on but no fall protection measures in place or in use. As a result, the employee was exposed to falls from heights of approximately 10 foot - 8 inches.
