Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a. Located at 9115 Pomodoro Drive, Hilliard, OH 43026: On or about April 22, 2024, the employer used an unguarded window opening at a height of approximately 13' to toss refuse and building materials from the under-construction second floor to the ground outside, which exposed employees to fall hazards in excess of 6'.

29 CFR 1926.1053(b)(1):When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grabrail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. a. Located at 9115 Pomodoro Drive, Hilliard, OH 43026: On or about April 22, 2024, the employer failed to position and/or extend their portable ladder used to access the second floor of an under-construction residence so that the ladder side rails extended at least 3 feet beyond the upper landing surface, a window opening, which was used by employees to gain access. Fernando Alvarado was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard. 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1499115, citation number 1, item number 2, and was affirmed as a final order on March 1, 2021, with respect to a workplace located at 3635 Mystic Way, Grove City, OH 43123. Fernando Alvarado was previously cited for a violation of this Occupational Safety and Health Standard or its equivalent standard. 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 1406433, citation number 1, item number 4, and was affirmed as a final order on October 11, 2019, with respect to a workplace located at 5377 Bulleit Drive, Westerville, OH 43081.
