29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): a) On or about October 28, 2020, at the west end and center area of the trench, at a depth of approximately 7 feet, employees were not protected from the hazard of cave-ins. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer: a) On or about October 28, 2020, at the east end of the trench the protective system for cave-in protection at a depth of approximately 8 feet was not constructed in accordance with the manufacturer's tabulated data where only one hydraulic cylinder was used. b) On or about October 28, 2020, at the east end of the trench the protective system for cave-in protection at a depth of approximately 8 feet was not constructed in accordance with the manufacturer's tabulated data where sheeting was not within 2 feet of the bottom of the trench. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
