Employees were throwing roofing materials off a residential roof onto the ground level, exposing the employee to struck-by hazards from falling objects. No abatement certification or documentation is required for this item.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On or about October 29, 2020, employees were exposed to fall hazards between 9 feet, 2 inches and 16 feet, 10 inches high while engaged in residential roofing activities. Fall protection was not being utilized while performing roofing operations. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.502(d)(17): The attachment point of the body harness was not located in the center of the wearer's back near shoulder level, or above the wearer's head. On or about October 29, 2020, employees were exposed to fall hazards approximately 10 feet, 5 inches high while performing roofing operations on a residential property. An employee was observed not using fall protection correctly when the lifeline lanyard was connected to the front nylon straps while performing roofing operations. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

29 CFR 1926.503(b)(1): The employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training. On or about October 29, 2020, the employer failed to certify that employees had been trained to recognize and minimize fall hazards. Employees were exposed to fall hazards between 9 feet, 2 inches and 16 feet, 10 inches high while performing roofing activities on a residential structure without properly using fall protection. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
