29 CFR  1926.1051(a): A stairway or ladder shall be provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided.  a. On or about November 2, 2020, at the Fischer Homes residential job site, APT 606, in the Adena Pointe community, employees climbed down through the framing from the second floor without the use of a ladder or stairway, thereby exposing employees to a fall hazard of approximately 10 feet, 0.5 inch.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about November 2, 2020, at the Fischer Homes residential job site, APT 606, in the Adena Pointe community, employees involved in framing activities on the second floor and wall top plates were not protected against exterior falls, thereby exposing the employees to a fall hazard up to 15 feet, 6 inches.  b. On or about November 2, 2020, at the Fischer Homes residential job site, APT 606, in the Adena Pointe community, employees involved in framing activities on the second floor and wall top plates were not protected against interior falls, thereby exposing the employees to a fall hazard of 10 feet, 0.5 inch (first floor) to 18 feet, 10 inches (basement floor).  c. On or about November 2, 2020, at the Fischer Homes residential job site, APT 606, in the Adena Pointe community, employees involved in framing activities on the first floor were not protected against an interior fall to the basement due to an unguarded opening, thereby exposing the employees to a fall hazard of approximately 8 feet, 9.5 inches.  Jorge Gomez was previously cited for a serious violation of this occupational safety and health standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1423718, citation number 1, item number 3 and was affirmed as a final order on December 4, 2019, with respect to a workplace located at Lot 409, 6950 Scarlet Oak Drive, Hilliard, OH 43026.
