29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems: Note: If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented. On or about November 4, 2020, and at times prior thereto, framing employees working at the edge of a commercial construction project were not protected from falls. Employees were exposed to a fall hazard of approximately 15 feet to the ground below. Alfredo Castillo DBA AC Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(2)(i), which was contained in OSHA inspection number 1358550, citation number 1, item number 1 and was affirmed as a final order on January 23, 2019, with respect to a workplace located at 25630 Kuykendahl Rd, Tomball TX 77375.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: On or about November 4, 2020, and at times prior thereto, framing employees working at the edge of a commercial construction project were not protected from falls. The employer did not provide a training program for employees to understand, recognize and avoid fall hazards.
