29 CFR 1910.22(d)(1):(1) Walking-working surfaces were not inspected, regularly and as necessary, and maintained in a safe condition: (a) Nutrien Ag Solutions, Inc. at 806 West Broadway, Vermillion, SD 57069: On or about and at times prior to November 3, 2020 the employer did not ensure that an upper catwalk had been inspected to ensure and maintain a safe condition. Two employees were working on the upper catwalk attempting to unclog a fertilizer auger system when a six-foot section of catwalk collapsed and fell approximately 27 feet to the concrete ground below. As a result, one employee was injured and hospitalized due to the fall and impacting the concrete below.

29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): (a) Nutrien Ag Solutions, Inc. at 806 West Broadway, Vermillion, SD 57069: On or about and at times prior to November 3, 2020, the employer did not ensure that employees were protected from fall hazards in that the upper catwalk within the fertilizer shed did not have sufficient guardrail systems erected on the north side of the catwalk. This condition exposed employees to fall hazards over 20 feet.

29 CFR 1910.147(c)(8):Lockout or tagout was not performed only by the authorized employees who are performing the servicing or maintenance: (a) Nutrien Ag Solutions, Inc. at 806 West Broadway, Vermillion, SD 57069: On or about and at times prior to November 3, 2020, the employer did not ensure that employees who were conducting servicing on the upper auger system within the fertilizer shed to unclog material were protected from caught-in hazards. Employees who performed servicing on the fertilizer shed auger did not perform the lockout/tagout of the electrical systems themselves. This condition exposed employees to accidental start up of the machinery and caught-in hazards of the auger system.
