On or about November 04, 2020, located at 1907 Gingerfield Way, Lot 186 North Star, Sunbury, Ohio: the employer did not initiate and maintain a safety and health program to ensure hazard detection and correction, while employees installed framing lumber at the worksite. Two employees worked unprotected on the second floor level exposed to falls at elevation and struck-by hazards when they operated the pneumatic nail gun. The employees worked this way for approximately four hours. Mr Jos� Luis Barcenas Flores was previously cited for a serious violation for this occupational safety and health standard 29 CFR 1926.20(b)(1), which was contained in OSHA inspection number 1474231, citation number 1, item number 1 and was affirmed as final order on June 16, 2020, with respect to a workplace located at 1743 Silver Lawn Drive, Lot#114, Grove City, OH, 43123.

On or about November 04, 2020, located at 1907 Gingerfield Way, Lot 186 North Star, Sunbury, Ohio: the employer failed to instruct employees on the avoidance of unsafe conditions while they installed framing lumber at the worksite. As a result the employees were exposed to a fall distance 10 feet 1 inch at elevation to the ground level and struck-by hazards from the pneumatic nail gun without eye protection. The employee had not used appropriate eye protection when he conducted the task and was therefore exposed to struck-by hazards. 29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. a. On or about November 04, 2020, located at 1907 Gingerfield Way, Lot 186 North Star, Sunbury, Ohio: the employer failed to ensure that two employees were protected from falls when they conducted work on the second floor level of a new build residential home . The employees were exposed to a fall distance of 10 feet 1 inch to the lower level. Mr Jos� Luis Barcenas Flores was previously cited for a repeat serious violation of this occupational safety and health standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1474231, citation number 2, item number 1 and was affirmed as a final order on June 16, 2020, with respect to a workplace located at 1743 Silver Lawn Drive (lot# 114), Grove City, Ohio.
