29 CFR 1915.73(d):When employees are exposed to unguarded edges of decks, platforms, flats, and similar flat surfaces, more than 5 feet above a solid surface, the edges shall be guarded by adequate guardrails meeting the requirements of 1915.71(j)(1) and (2), unless the nature of the work in progress or the physical conditions prohibit the use or installation of such guardrails. Boatyard: The following locations had inadequate standard guard rails creating fall hazards over 5 feet into the water: 1. Gangway leading to the dock, the section on the left had a slack top rope and no mid-rail. The rope was 24" high, 23" wide. 2. Northside ladder adjacent to crane, the rope on the right side of the ladder was 29" high and there was an opening 17" wide. On the left side of the ladder, the opening was 28" high and 10" wide. 3. Southside opening across from crane, the rope "guarding" the opening was 30" high and 23" wide.

29 CFR 1915.158(b)(3):At least one 30-inch (0.76 m) U. S. Coast Guard approved ring life buoy with a line attached shall be located on each staging alongside of a floating vessel on which work is being performed. Boatyard, dock: The employer did not provide a throw ring with at least a 90 foot rope dockside where employees work near and over water. Employees are exposed to hypothermia and drowning hazards if they fall into the water.
