29 CFR 1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Mohican Structures, LLC, at a jobsite located at 4460 Green Cook Road, Westerville, OH 43082: On and/or preceding November 3, 2020, the employer did not ensure employees were adequately protected from falls while engaged in residential construction activities. An employee was working from the top plate of a wall while exposed to fall hazards of up to 12 feet 6 inches. Mohican Structures, LLC was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1427440, citation number 1, item number 3 and was affirmed as a final order on October 16, 2020, with respect to a workplace located at 1100 Sugarbush Drive, Ashland, OH 44805.
