Employees were working below other employees who were framing the roof while using a powered nail gun and hand tools. The employees were not utilizing head protection, which exposed them to struck-by hazards.

Framers were using a Paslode nail gun and a circular saw in the framing process. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. a) Ronald Todd Staten, at a jobsite located at 12854 Fancher Road, Westerville, Ohio 43082: On and/or preceding November 4, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employee were framing the second story roof without any means of fall protection, thereby being exposed to fall hazards of up to 20 feet. b) Ronald Todd Staten, at a jobsite located at 12854 Fancher Road, Westerville, Ohio 43082: On and/or preceding November 4, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employee were working adjacent to unguarded second story window openings without any means of fall protection, thereby being exposed to fall hazards of up to 15 feet.
