29 CFR OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees who were exposed to crushing and struck-by hazards while operating the automotive lifts: Shop area- On or about November 5, 2020, employees were exposed to a crushing and struck-by hazards while working around three Mohawk 2-post automotive lifts and one Rotary 2-post automotive lift in that: a) The employer failed to inspect at minimum on an annual basis to ensure continued safe operation of the lift. b) The employer failed to inspect on a daily basis or take notice of the lift structure in a raised position to ensure proper operation of all features, in that the Mohawk lift #4 had two leaking pistons affecting the ability to keep the lift in the raised position and the ability to control the lowering speed of the lift from the raised position. c) The employer failed to train employees in the safe operation of the automotive lifts. d) The employer failed to keep in the location appropriate lift documentation including manufacturer installation, operation, inspection and maintenance instructions.

The emergency exit door in the back of the establishment was obstructed by cardboard boxes and cleaning equipment, exposing employees to fire hazards.
