29 CFR  1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i):   a) Mavis Discount Tire, Inc 20 W Jericho Tpke, Huntington Station, NY - Employees onsite were exposed to fall hazards of approximately 10-feet while working on the mezzanine level near the stairwell and tire hoist area when not in operation due to a missing guardrail; on or about February 11, 2025.   b) Mavis Discount Tire, Inc 20 W Jericho Tpke Huntington Station, NY - Employees onsite were exposed to fall hazards of approximately 10-feet while retrieving tires from the mezzanine storage rack due to a missing guardrail; on or about September 10, 2025.   Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:  a) Workplace, Rim Cleaning Area- Employees exposed to corrosive materials such as Chem-Tel Full Throttle DOT Motor Vehicle Brake Fluid, which contains triethylene glycol, monobutyl ether, were not provided with suitable facilities for quick drenching or flushing of the eyes; on or about 9/10/24.  Mavis Discount Tire, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.151(c) , which was contained in OSHA inspection number1713166, citation number 1, item number 2 and was affirmed as a final order on 12/6/2024, with respect to a workplace located at261 Jericho Turnpike, Syosset, NY, 11791.  Note:  In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR  1910.157(c)(1): Portable fire extinguishers were not mounted, located and identified so that they were readily accessible without subjecting the employees to injuries:  a) Mavis Discount Tire Inc,  20 W Jericho Tpke, Huntington Station, NY - A fire extinguisher was stored on the ground next to the used oily rags bin and wash sink. The extinguisher was not mounted on a wall and easily accessible and identified; on or about February 11, 2025.   Mavis Discount Tire, Inc was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1910.157(c)(1), which was contained in OSHA inspection number 1713166, citation number 1, item number 3 and was affirmed as a final order on 12/06/2024, with respect to a workplace located at 261 Jericho Turnpike, Syosset, NY, 11791.  Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
