29 CFR  1910.1200(e)(1):  The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met and the employer had not developed or implemented a written hazard communication program which at least included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii):  (Construction Reference: 1926.59)  A.)  Shirin K. Mirzayev dba Super-Roofer, 2881 Mechanic Street, Lake City, PA 16423, on or about November 4, 2020 and times prior thereto:  Employees were using chemicals including, but not limited to, Firestone Single-Ply LVOC Bonding Adhesive (W56-358-715L) during roofing operations.  The employer did not develop and implement a written hazard communication program.  ABATEMENT CERTIFICATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation (see below). 29 CFR  1926.501(b)(4)(i):  Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes:  A.)  Shirin K. Mirzayev dba Super-Roofer, 2881 Mechanic Street, Lake City, PA 16423, on or about November 4, 2020 and times prior thereto:  Employees were exposed to fall hazards through roof openings for HVAC units when working at a height of 18.1-feet when performing roofing activities.  The openings were not guarded by covers or guardrails.  Employees were not utilizing any fall protection systems.   Shirin K. Mirzayev dba Super-Roofer was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(4)(i), which was contained in OSHA inspection number 1189636, citation number 1, item number 2 and was affirmed as a final order on June 30, 2017, with respect to a workplace located at 818-824 State Street, Erie, PA  16501.  ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED: Abatement certification is required within 10 days after the abatement date noted on the citation.  This certification shall include a statement that abatement is complete, the date abatement was completed, method of abatement, and state that employees and their representatives were informed of this abatement. IN ADDITION, abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic, or video evidence or abatement or other written records.

Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.  A.)  Shirin K. Mirzayev dba Super-Roofer, 2881 Mechanic Street, Lake City, PA 16423, on or about November 4, 2020 and times prior thereto:  Employees were exposed to fall hazards when working at heights of between 18.1-feet and 20.5-feet on a low-sloped roof when performing roofing activities. The employer had portable dry chemical fire extinguishers on-site.  Employees were permitted to use the portable dry chemical fire extinguishers.  Employees did not have training on the proper selection and use of portable fire extinguishers.  B.)  Shirin K. Mirzayev dba Super-Roofer, 2881 Mechanic Street, Lake City, PA 16423, on or about November 4, 2020 and times prior thereto:  Employees were provided with personal protective equipment including, but not limited to, Hand Crew nitrile coated gloves.
