29 CFR  1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about November 6, 2020, at the Ryan Homes residential job site, Lot 6857, in the Ewing Meadows community, the employer failed to maintain and enforce a safety program to ensure hazard detection and correction including, but not limited to, fall protection.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.  Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about November 6, 2020, at the Ryan Homes residential job site, Lot 6857, in the Ewing Meadows community, employees involved in framing activities on the second floor were not protected against exterior falls, thereby exposing the employees to a fall hazard of 10 feet, 11 inches to 16 feet, 5.5 inches.  b. On or about November 6, 2020, at the Ryan Homes residential job site, Lot 6857, in the Ewing Meadows community, employees involved in framing activities on the second floor were not protected against interior falls, thereby exposing the employees to a fall hazard of approximately 18 feet, 11.5 inches to 19 feet, 0.5 inch to the basement floor.  c. On or about November 6, 2020, at the Ryan Homes residential job site, Lot 6857, in the Ewing Meadows community, employees involved in framing activities on the second floor were not protected against interior falls, thereby exposing the employees to a fall hazard of approximately 12 feet, 0.25 inch to the garage floor.  d. On or about November 6, 2020, at the Ryan Homes residential job site, Lot 6857, in the Ewing Meadows community, employees involved in framing activities on the first floor were not protected against an interior fall to the basement due to an unguarded opening, thereby exposing the employees to a fall hazard of approximately 8 feet, 11.5 inches to 9 feet, 0.5 inch.
