29 CFR  1903.19(c)(1):Within 10 calendar days after the abatement date, the employer must certify to OSHA (the Agency) that each cited violation has been abated, except as provided in paragraph (c)(2) of this section.  The Employer did not provide the Occupational Safety and Health Administration (OSHA) certification of abatement as required for Citation #1, Items #1, #2, #3 & #4 issued on December 22, 2020.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:  At jobsite located at 2875 Anna Ct. Wichita, KS, the employer did not ensure that appropriate permission from the manufacturer was obtained by the user prior to using an attachment on the JLG Telehandler, and did not ensure that markings for the capacity, operation and maintenance were changed accordingly. This condition exposes employees to struck-by and crushing hazards.

29 CFR 1926.1053(b)(4): Ladder(s) were used for purposes other than the purpose for which they were designed:  At the jobsite located at 2875 Anna Ct Wichita, Kansas, employees engaged in residential framing activities using a Werner 8 foot A-frame ladder, were exposed to fall hazards of approximately 8 feet from the top of the ladder to the ground below in that the top rung of the step ladder was used as the working platform.
