29 CFR  1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   a)  At 610 West Beach Boulevard, Beachside Resort Hotel, Gulf Shores, Alabama:   On or about November 10, 2020 and at times prior;  the employer failed to ensure employees were trained on the hazards associated with fall to include but not limited to setting up fall protection and inspecting fall protection exposing his employees to a fall hazard of up to 40 feet to the ground below.

29 CFR  1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated:   a)  At 610 West Beach Boulevard, Beachside Resort Hotel, Gulf Shores, Alabama:   On or about November 10, 2020 and at times prior;  the employer failed to ensure employees operating an aerial lift were using fall protection during its operations exposing his employees to a fall hazard of up to 40 feet to the ground below.
