29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.    a) On or about November 10, 2020, at the above addressed jobsite, employees conducting masonry operations from a tubular welded frame scaffold, twelve (12') feet six (6") inches above the ground, were not provided with an access ladder, thereby exposing the employee to falls.  No abatement certification or documentation is required for this item.

29 CFR  1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level.  a) On or about November 10, 2020, at the above addressed jobsite, employees conducting masonry operations from a tubular welded frame scaffold, twelve (12') feet six (6") inches above the ground, were not provided with guardrails, midrails, cross rails or other means of fall protection, thereby exposing the employee to falls.  No abatement certification or documentation is required for this item.

29 CFR  1926.452(w)(2):Scaffold casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold was used in a stationary manner:  a) On or about November 10, 2020, at the above addressed jobsite, employees conducting masonry operations from a tubular welded frame scaffold, twelve (12') feet six (6") inches above the ground, were working without all of the casters locked.    No abatement certification or documentation is required for this item.

29 CFR  1926.454(b):The employer did not have each employee involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question:  a) On or about November 10, 2020, at the above addressed jobsite, tubular welded frame scaffold was erected by untrained individuals.  The employer failed to ensure that trained individuals directed the erection of the scaffolding to ensure safety to the employees that were required to perform masonry work from the structure.   In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
