29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference: 1926.59):  (a) Throughout the jobsite, the employer had not developed, implemented, and maintained a written hazard communication program for employees performing masonry installation operations who were exposed to hazardous chemicals including, but not limited to TXI White Masonry Cement (contains Portland cement, respirable crystalline silica dust, and hexavalent chromium),  which can result in silicosis, lung cancer, COPD, skin burns, serious eye damage.

29 CFR  1926.451(e)(1):When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  (a) On or about November 10, 2020 employees , who were working from the tubular welded scaffold did not have a ladder on the tubular welded scaffold. Employees climbed on the cross braces and were exposed to the hazard of falling 6 to 18-feet to the ground below.
