29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about November 13, 2020, for the 5472 Branchville Drive, Canal Winchester, Ohio worksite: the employer had not developed, initiated and maintained accident prevention programs, such as but limited to a fall protection and other protective equipment programs,  such as eye protection; for employees performing framing carpentry work. While performing required framing carpentry related work duties, employees were unprotected from fall hazards while working from heights of 12 feet and higher.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   a. On or about November 13, 2020, for the 5472 Branchville Drive, Canal Winchester, Ohio worksite: the employer did not ensure that framing carpenters involved with installing roof sheathing using pneumatic nail guns used appropriate eye protection. Employees were exposed to increased risk for eye injury from flying particles and objects while operating these tools to fasten wooden materials such as OSB sheathing, during framing carpentry activities.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about November 13, 2020, for the 5472 Branchville Drive, Canal Winchester, Ohio worksite: Employees were not protected from falling while installing OSB roof sheathing on the front porch roof surface of a single family residential home under new build construction.  The employer had not installed guardrail systems, or safety net systems. The employer did not utilize personal fall arrest systems for individual employee fall protection. While performing required framing carpentry related work duties, employees were unprotected from fall hazards while working from heights of  approximately 12 feet.

29 CFR  1926.503(a)(1):The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  a. On or about November 13, 2020, for the 5472 Branchville Drive, Canal Winchester, Ohio worksite: the employer did not have and did not provide a fall protection training program for framing carpenters. Employees performed required duties with exposure to fall hazards, including framing carpenters employed to work installing OSB roof sheathing on the front porch roof surface.
