29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Rodriguez Construction LLC, at a jobsite located at Lot 876, Sunbury, Ohio 40374: On and/or preceding November 18, 2020, the employer failed to initiate and maintain a safety and health program such as but not limited to personal protective equipment program, an electrical safety program, and a fall protection program for employees conducting framing work.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Rodriguez Construction LLC, at a jobsite located at Lot 876, Sunbury, Ohio 40374: On and/or preceding November 18, 2020, the employer did not ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Framers were using pneumatic nail guns and circular saws in the framing process. The employees were not utilizing eye protection, which exposed them to struck-by hazards to the eyes.

The path to ground from circuits, equipment, and enclosures shall be permanent and continuous.  a) Rodriguez Construction LLC, at a jobsite located at Lot 876, Sunbury, Ohio 40374: On and/or preceding November 18, 2020, the employer did not ensure employees who used an electrically powered air compressor were protected from electrical contact hazards. Framers were using an air compressor with the ground prong missing from the end of a cord, which exposed the employees to a 114 volt electrical contact hazard.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.   a) Rodriguez Construction LLC, at a jobsite located at Lot 876, Sunbury, Ohio 40374: On and/or preceding November 18, 2020, the employer did not ensure employees were protected from falls while engaged in residential construction activities. Employee were framing a new construction house without any means of fall protection, thereby being exposed to fall hazards of up to 15 feet, 4 inches.
