29 CFR 1910.120(q)(1): The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations: a) Global Chemical Resources located at 719 Brown Avenue in Toledo, Ohio 43607; On or about November 6, 2020 the employer did not develop an emergency response plan for emergencies that addressed personnel roles such as but not limited to hazardous materials technicians. Employees were exposed to hazards associated with styrene such as, but not limited to, eye irritation, irritating to skin, and chemical pneumonitis, while stopping the release of styrene during a chemical spill.

29 CFR 1910.120(q)(6)(iii):Employees who participated as hazardous materials technicians, or were expected to participate as hazardous materials technicians, had not received at least 24 hours of training equal to the first responder operations level, and in addition have competency in the areas outlined in 29 CFR 1910.120(q)(6)(iii)(A) through (q)(6)(iii)(I) and/or the employer did not so certify: a) On or about November 6, 2020 the employer did not ensure that employees who participated as hazardous materials technicians, or were expected to participate as hazardous materials technicians received at least 24 hours of training equal to the first responder operation level. Employees were exposed to hazards associated with styrene such as, but not limited to, eye irritation, irritating to skin, and chemical pneumonitis, while stopping the release of styrene during a chemical spill.
