29 CFR 1910.134(d)(1)(i): Selection of appropriate respirators was not based on the respiratory hazard(s) to which the worker was exposed and user factors that affect respirator performance and reliability: (a) Superior Rehabilitation Center, LLC. located at 1800 New York Ave. Superior, WI 54880: November 9, 2020 and times thereafter, the employer did not select an appropriate respirator for employees to protect against the SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents. The employer provided and required surgical masks at the start of the outbreak, until November 11, 2020, when unapproved KN95s were then provided and required.

The employer provided and required employees to wear unapproved KN95s to protect against SARS-CoV-2 virus while providing care to suspected and confirmed positive COVID-19 residents.
