On or about December 10, 2020, employees were exposed to respiratory hazards while wearing a 3M brand filtering face piece respirators without having been fit tested before initial use. b. 29 CFR 1910.134(g)(1)(i)(A):Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function: On or about December 1, 2020, an employee was required to wear a tight fitting 3M brand half-face respirator without having their facial hair trimmed or shaven so that the facial hair did not interfere with the face mask sealing surface.

29 CFR 1910.1053(c):The employer did not ensure that no employee was exposed to an airborne concentration of respirable crystalline silica in excess of 50 ug/m3, calculated as an 8-hour TWA: In the following instances, two employees were exposed to silica in excess of the permissible exposure level (PEL) for the 8-hour time weighted average concentration: a. An employee who was conducting bagging and bag watching operations on the Q2 line was exposed to silica at a time weighted average of 114.8 ug/m3. This level exceed the permissible exposure level for silica of 50ug/m3 by 2.29 times. This exposure was derived from samples collected over a 447 minute sampling period on December 10, 2020. b. An employee who was conducting bagging and bag watching operations on the Q2 line was exposed to silica at a time weighted average of 71.2 ug/m3. This level exceed the permissible exposure level for silica of 50ug/m3 by 1.42 times. This exposure was derived from samples collected over a 447 minute sampling period on December 10, 2020.

29 CFR 1910.1053(f)(1):The employer did not use engineering and work practice controls to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL, unless the employer can demonstrate that such controls are not feasible: On or about December 10, 2020 employees were exposed to respirable silica above the permissible exposure limit while bagging ready mix concrete without engineering or work practice controls in place to reduce employee exposure.
