29 CFR 1910.95(c)(1):The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment. a) On or about January 6, 2021 the employer had not instituted a hearing conservation program for employees working the plastic re-grind who were exposed above the action level (AL) of 85 dbA for an 8-hour time-weighted average.

29 CFR 1910.1200(f)(6)(ii): Labels and other forms of warning- Workplace labeling. Except as provided in paragraphs (f)(7) and (f)(8) of this section, the employer shall ensure that each container of hazardous chemicals in the workplace is labeled, tagged or marked with either: Product identifier and words, pictures, symbols, or a combination thereof, which provide at least general information regarding the hazards of the chemicals, and which, in conjunction with the other information immediately available to employees under the hazard communication program, will provide employees with the specific information regarding the physical and health hazards of the hazardous chemical. a) The employer did not ensure that all the bottles in the maintenance area (i.e. 32 sports drink and small squeeze bottles),that contained chemicals such as but not limited to lubricants (irritants) were labeled with a product identifier and words, pictures, and or symbols of the hazards of the chemicals contained therein.
