29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards of propagation of a fire, deflagration or other fire hazards, and/or explosion that caused or were likely to cause death or serious physical harm to employees: a) Sanding Department: On or about 11/25/2020, although the sanding machinery was equipped with a dust collector it was not operational, and did not remove accumulated combustible dust that was generated by other wood cutting equipment such as, but not limited to; the Ridgid chop saw (Serial # U064821501 & Model # MS1250LZ1). Employees who work in Sanding department or in the immediate vicinity were exposed to fire hazards in the event of a deflagration or other uncontrolled fire event.

29 CFR 1910.22(a)(1): Poor housekeeping in the work area created unsafe conditions. On or about 11/25/2020, the flooring in the Sanding department was not maintained in a clean and safe condition. Excessive wood dust was allowed to accumulate on the walking/working surfaces and around the Ridgid chop saw (Serial # U064821501 & Model # MS1250LZ1) thus exposing employees to hazards created by combustible wood dust (e.g.: fire hazards to including flames and hazardous byproducts: smoke, toxic gases, etc.) and slip hazards.
