29 CFR  1910.147(c)(4)(i): Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section.   Note: Exception: The employer need not document the required procedure for a particular machine or equipment, when all of the following elements exist: (1) The machine or equipment has no potential for stored or residual energy or reaccumulation of stored energy after shut down which could endanger employees; (2) the machine or equipment has a single energy source which can be readily identified and isolated; (3) the isolation and locking out of that energy source will completely deenergize and deactivate the machine or equipment; (4) the machine or equipment is isolated from that energy source and locked out during servicing or maintenance; (5) a single lockout device will achieve a locked-out condition; (6) the lockout device is under the exclusive control of the authorized employee performing the servicing or maintenance; (7) the servicing or maintenance does not create hazards for other employees; and (8) the employer, in utilizing this exception, has had no accidents involving the unexpected activation or reenergization of the machine or equipment during servicing or maintenance.   a. On or about April 20, 2021, and at times prior, in the Distribution Center, the employer did not develop or document a procedure for the control of the hazardous energy associated with the Pushers on the Packaging Line. Employees performed maintenance and servicing on the Pushers on the Packaging Line without a procedure developed and documented thereby exposing employees to struck-by and caught-between hazards associated with the uncontrolled pneumatic energy.

29 CFR  1910.147(c)(4)(ii): The procedures shall clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, the following:  29 CFR  1910.147(c)(4)(ii)(C): Specific procedural steps for the placement, removal and transfer of lockout devices or tagout devices and the responsibility for them;  a. On or about April 4, 2021, and at times prior, employees performed group maintenance and servicing activities on the Large Pack and Packaging conveyor lines. There was no procedure documented and in place to outline placing of locks, removal, and transfer of locks when working and performing lockout in groups.

On or about April 20, 2021, and at times prior, authorized employees who used lockout for energy control in the Large Pack Area and Packaging Line were not included in a periodic inspection review of their responsibilities under the energy control procedure. 29 CFR  1910.147(c)(7)(i)(A): Each authorized employee shall receive training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control.  a. On or about April 20, 2021, and at times prior, employees authorized to perform lockout and tagout in the Distribution Center had not received adequate training. Employees performing lockout/tagout and clearing of jams on the Large Pack and Packaging Lines were unaware of the magnitude of energy and were unaware of the means necessary for verification of zero energy state prior to performing maintenance and servicing activities. As a result, employees were exposed to potential electrical and pneumatic energy sources associated.

The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):  a. On or about April 19, 2021, and at times prior, an employee was exposed to caught-in/between machine hazards associated with moving parts during servicing and maintenance on photo-eyes on the Large Pack conveyor line. The employer failed to implement energy control application steps as verification of isolation [per the 1910.147(d)(6) requirements] was not completed to protect employees from machine servicing hazards.   b. On or about April 19, 2021, and at times prior, an employee was exposed to caught-in/between machine hazards associated with moving parts during servicing and maintenance to clear jammed totes/parts on the Large Pack conveyor line. The employer failed to implement energy control application steps as verification of isolation [per the 1910.147(d)(6) requirements] was not completed to protect employees from machine servicing hazards.   c. On or about April 19, 2021, an employee was exposed to struck-by machine hazards associated with moving parts and totes during servicing and maintenance to clear jammed totes on the Packaging conveyor line. The employer failed to implement energy control application steps as LOTO devices were not applied to the electrical disconnect [per the 1910.147(d)(4) requirements]. As a result, the remaining applicable energy control elements, involving dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.   d. On or about April 17, 2021, and at times prior, an employee was exposed to struck-by and caught-in/between machine hazards associated with moving parts during servicing and maintenance to clear jammed totes/parts on the Large Pack Line. The employer failed to implement energy control application steps as verification of isolation [per the 1910.147(d)(6) requirements] was not completed to protect employees from machine servicing hazards.    e. On or about April 4, 2021, and at times prior, two employees were exposed to caught-in/between machine hazards associated with moving parts during servicing and maintenance to change a roller on the Large Pack conveyor line. The employer failed to implement energy control application steps as verification of isolation [per the 1910.147(d)(6) requirements] was not completed to protect employees from machine servicing hazards.   f. On or about February 23, 2021, and at times prior, an employee was exposed to struck-by hazards associated with moving parts and totes during servicing and maintenance to clear jammed totes on the Packaging conveyor line. The employer failed to implement energy control application steps as verification of isolation [per the 1910.147(d)(6) requirements] was not completed to protect employees from machine servicing hazards.   g. On or about November 23, 2020, and at times prior, an employee was exposed to struck-by and caught-in/between hazards associated with moving parts and pinch points during servicing and maintenance to replace three rollers between Stations 1 and 2 on the Packaging conveyor line. The employer failed to implement energy control application steps as verification of isolation [per the 1910.147(d)(6) requirements] was not completed to protect employees from machine servicing hazards.   h. On or about November 20, 2020, and at times prior, an employee was exposed to struck-by and caught-in/between hazards associated with moving parts and pinch points during servicing and maintenance to replace a pusher on Dot Door 5 on the Packaging conveyor line. The employer failed to implement energy control application steps as  LOTO devices were not applied to the air disconnect [per the 1910.147(d)(4) requirements]. As a result, the remaining applicable energy control elements, involving dissipation of residual energy [(d)(5)(i), and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.

29 CFR  1910.147(f)(3)(i): When servicing and/or maintenance is performed by a crew, craft, department or other group, they shall utilize a procedure which affords the employees a level of protection equivalent to that provided by the implementation of a personal lockout or tagout device.  a. On or about April 5, 2021, and at times prior, employees performed group maintenance and servicing activities on the Large Pack and Packaging conveyor lines. Employees did not utilize a group lockout procedure and only one lock was placed on the equipment when working in groups of two or more.
