OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer utilized damaged storage rack systems, exposing employees to struck-by and crushing hazards:  a.) JEGS Automotive, Inc., at the jobsite located at 101 Jegs Place, Delaware, Ohio 43015: On and/or preceding January 20, 2022, the Frazier Industrial storage rack systems located in the automotive parts distribution warehouse  which was used to store automotive parts had unbolted foot plates, multiple damaged columns due to forklift impact and damaged horizontal and diagonal struts, thereby exposing employees to struck-by hazards. 29 CFR 1910.303(b): Examination, installation, and use of equipment --  29 CFR 1910.303(b)(1): Examination. Electric equipment shall be free from recognized hazards that are likely to cause death or serious physical harm to employees. Safety of equipment shall be determined using the following considerations:  29 CFR  1910.303(b)(1)(iv):Electrical insulation;  a.) JEGS Automotive, Inc., at the jobsite located at 101 Jegs Place, Delaware, Ohio 43015: On and/or preceding January 20, 2022, the electrical flexible cable used to connect the 36 volt, V-Force battery to the RC Crown stand-up rider lift truck had damaged insulation and was improperly repaired with standard electrical tape. The damaged flexible cable was subject to repeated displacement from regular operator use, thereby exposing employees to an electrical hazards.

When normally enclosed live parts are exposed for inspection or servicing, the working space, if in a passageway or general open space, shall be suitably guarded.  a.) JEGS Automotive, Inc., at the jobsite located at 101 Jegs Place, Delaware, Ohio 43015: On and/or preceding January 20, 2022, the employer did not ensure that the working space in front of the electrical panels located in the warehouse remained clear from storage of material and equipment, such as, but not limited to, shovels, dust mops and empty containers, thereby restricting access to the controls in the event of an emergency.
