On or about December 3, 2020, employees were applying stucco and decorative stone to the residential apartments under construction working from a three tier tubular welded scaffold that did not have guard rails, exposing the employees to a fall hazard.

29 CFR  1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  On or about December 3, 2020, employees were applying stucco and decorative stone to the residential apartments under construction working from a three tier tubular welded scaffold that did not have a ladder for access, exposing the employees to a fall hazard.   Juan Ortiz was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.451(e)(1), which was contained in OSHA inspection number 1447011, citation number 1, item number 2 and was affirmed as a final order on January 9, 2020, with respect to a workplace located at 2701 I-35 Round Rock Texas 78664.  Juan Ortiz was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.451(e)(1), which was contained in OSHA inspection number 1428798, citation number 1, item number 2 and was affirmed as a final order on December 19, 2019, with respect to a workplace located at 1401 S. IH-35 Georgetown, TX 78626.

29 CFR  1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:    On or about December 3, 2020, employees were applying stucco and decorative stone to the residential apartments under construction working from a three tier tubular welded scaffold up to approximately 18 feet high without toeboards, exposing the employees to the hazard of being struck-by tools and materials.  Juan Ortiz was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR  1926.451(h)(2)(ii) which was contained in OSHA inspection number 1428798, citation number 1, item number 3 and was affirmed as a final order on December 19, 2020, with respect to a workplace located at 1401 S. IH-35 Georgetown, TX 78626.
