OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from the hazard of contracting the virus, SARS-CoV-2 (severe acute respiratory syndrome coronavirus 2), the cause of the COVID-19 disease. On or about December 09, 2020, and continuing thereafter, employees working throughout the facility, including, but limited to, the Foam Dispensing Department and the Aluminum Solutions Department, worked in close proximity to each other during the COVID-19 pandemic. The employer did not fully implement and enforce social distancing, cleaning and disinfection, screening of employees prior to beginning their shifts, and contact tracing protocols. These conditions exposed employees to the hazard of contracting COVID-19 from other employees at the facility.

29 CFR 1904.4(a):The employer did not record each work-related fatality, injury or illness case that resulted in the general recording criteria on the OSHA Form 300 or equivalent. Silgan Dispensing Systems Thomaston Facility: On or about December 09, 2020, the employer did not record the following workplace illnesses on the OSHA 300 log or its equivalent: From the time period between November 07, 2020 and November 22, 2020, five (5) cases of COVID-19 infection resulted in 7 to 15 days away from work. Abatement Certification and Documentation is required.
