29 CFR 1910.28(b)(1)(i):(1) Unprotected sides and edges. (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the following: guardrail systems, safety net systems or personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems. Employees of DePere Foundry, Inc. were exposed to fall hazards of 12 feet when the employees were not protected by a guardrail systems, safety net systems or personal fall protection systems while using a roof to access the sand towers.

29 CFR 1910.28(b)(3)(iv):(iv) Each employee is protected from falling into a ladderway floor hole or ladderway platform hole by a guardrail system and toe-boards erected on all exposed sides, except at the entrance to the hole, where a self-closing gate or an offset must be used. Employees of DePere Foundry, Inc were not protected from falls when: a) the fixed ladder used to access the roof where the sand towers are located did not have an offset or self-closing gate in the ladderway platform hole. b) the fixed ladder used to access the north sand tower platform did not have an offset or self-closing gate in the ladderway platform hole.
