29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in this section 29 CFR 1910.28, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i): a) Sandblasting/Painting Area (Railroad Cradle Staging Area): On or about December 07, 2020, and at times prior; the employer required employees to perform sandblasting/painting operations while on top of cradles with unprotected sides and edges; exposing employees to fall hazards up to approximately eight feet (8') to the ground and railroad tracks below.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a) Fabrication Plant (Bay 3: Railroad Door Area): On or about December 07, 2020, and at times prior; the employer did not ensure that the HYSTER Lift Truck (Model: H80XL; Serial No. G005D07155S), which was in need of repair due to a defective horn, was taken out of service until it had been restored to safe operating condition; exposing employees to struck-by during plant operations.
