29 CFR 1910.95(g)(5)(i):The employer did not establish, within 6 months of an employee's first exposure at or above the action level, a valid baseline audiogram against which subsequent audiograms can be compared: a) Grinder operator: On or about March 13, 2025, and at times prior to, the employer exposed employees to noise dose at levels of 145.9% (equivalent to an 8-hour time weighted average TWA of 92.8 dBA) which is 1.49 times the Permissible Exposure Limit of 100% (equivalent to an 8-hour TWA of 90 dBA) while operating the portable DeWalt electric hand grinder. Results were calculated for a 427-minute sampling period. The employer failed to provide a baseline audiometric test to the employee within 6 months of employment.

29 CFR 1910.95(g)(6):At least annually after obtaining the baseline audiogram, the employer did not obtain a new audiogram for each employee exposed at or above an 8-hour time-weighted average of 85 decibels : a) Lathe operator : On or about March 13, 2025, and at times prior to, the employer exposed employees to noise dose at levels of 80.2% (equivalent to an 8-hour time weighted average TWA of 88.4 dBA) which is 1.6 times the Action Level of 50% (equivalent to an 8-hour TWA of 85 dBA) while operating the LeBlond manual lathe located next to the grinding station. Results were calculated for a 506-minute sampling period. The employer failed to provide an annual audiometric test to the employee.
