29 CFR 1910.178(p)(1): If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition. Location: Worksite Employees utilized two Powered Industrial Trucks that were defective and not taken out of service for repair. 1. The black and green Combi-CB Model 9000 diesel powered three-wheel forklift's the horn and the back-up warning alarm were not working. 2. The yellow and teal colored Komatsu Model FG40ZT-7 propane powered forklift's left side solid tires were missing chunks of rubber, the horn did not work and was leaking propane gas.

29 CFR 1910.178(q)(1): Any power-operated industrial truck not in safe operating condition shall be removed from service. All repairs shall be made by authorized personnel. Location: Worksite Employees utilized two Powered Industrial Trucks that were defective and not taken out of service for repair. Employees that were authorized to perform repairs to the forklifts did not repair them adequately and allowed them to be operated with the following deficiencies; 1. The black and green Combi-CB Model 9000 diesel powered three-wheel forklift was not properly maintained; the horn and the back-up warning alarm were not working. 2. 29 CFR 1910.178(q)(7): Industrial trucks were not examined before being placed in service and were placed in service when the examination showed condition(s) that would adversely affect the safety of the vehicle. Examinations were not made at least daily. Where industrial trucks are used on a round-the-clock basis, they were not examined after each shift. Location: Worksite Forklifts were not adequately examined prior to being placed back into service and continued to be operated with the following but not limited to deficiencies; non-working back up alarms, non-working horns, chunks of rubber missing from tires, and leaking propane gas.
