29 CFR 1910.178(a)(6): The user shall see that all nameplates and markings are in place and are maintained in a legible condition. On or about December 14, 2020, employees were required to operate a sit-down, Nissan powered industrial truck (PIT), and the employer did not ensure the forklift or PIT, was equipped with the proper nameplates and markings prior to operation. Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1910.178(l)(2)(ii):Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. On or about December 14, 2020, the employer did not ensure that employees assigned to operate powered industrial trucks (forklifts) for material handling tasks, were provided with complete formal training in workplace-specific and truck-related topics. Employees operating forklifts and those working around them were exposed to hazards associated with unsafe operation.
