29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  On or about December 18, 2020, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures.  The employer required employees to wear respirators when disassembling truck axles.    All provisions of 29CFR 1910.134(c) through (o) must be covered in a respiratory protection program.  Key elements include, but are not limited to the following:      1.  Selection of respirators for employees.     2.  Medical evaluations for employees.     3.  Fit testing.     4.  Training and information.     5.  Recordkeeping.

29 CFR  1910.134(e)(1):General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator.  On or about December 18, 2020, the employer did not provide medical evaluations to employees to determine the employee's ability to use a respirator prior to requiring the employees to use respirators when disassembling truck axles.

29 CFR  1910.134(f)(2): The employer shall ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter.   On or about December 18, 2020, the employer did not ensure that employees required to use a filtering facepiece respirator were fit tested prior to initial use.  Additionally, the employer did not ensure that employees that had been fit tested previously, had been fit tested annually thereafter.

29 CFR  1910.134(k):Training and information. This paragraph requires the employer to provide effective training to employees who are required to use respirators. The training must be comprehensive, understandable, and recur annually, and more often if necessary. This paragraph also requires the employer to provide the basic information on respirators in Appendix D of this section to employees who wear respirators when not required by this section or by the employer to do so.  On or about December 18, 2020, the employer did not provide training to employees who were required to wear respirators when disassembling truck axles.

29 CFR  1910.215(b)(9):Exposure adjustment. Safety guards of the types described in Subparagraphs (3) and (4) of this paragraph, where the operator stands in front of the opening, shall be constructed so that the peripheral protecting member can be adjusted to the constantly decreasing diameter of the wheel. The maximum angular exposure above the horizontal plane of the wheel spindle as specified in paragraphs (b)(3) and (4) of this section shall never be exceeded, and the distance between the wheel periphery and the adjustable tongue or the end of the peripheral member at the top shall never exceed one-fourth inch. (See Figures O-18, O-19, O-20, O-21, O-22, and O-23.)  On or about December 18, 2020, employees were exposed to struck-by hazards from a bench grinder with a missing safety guard in the Axle Teardown Department.

On or about December 18, 2020, employees were exposed to electric shock and fire hazards from a relocatable power tap used in the Axle Teardown Department to power a stereo system, circular saw, and a heat sealer.  b.  On or about December 18, 2020, employees were exposed to electric shock and fire hazards from a relocatable power tap used in the Aftermarket Packaging Department to power battery chargers, a fan, and an extension cord powering a small heater.

29 CFR  1910.305(g)(1)(iv)(A):Unless specifically permitted otherwise in paragraph (g)(1)(ii) of this section, flexible cords and cables may not be used as a substitute for the fixed wiring of a structure;  On or about December 18, 2020, employees were exposed to electric shock and fire hazards from an extension cord used as a substitute for fixed wiring in the Axle Teardown Department.  The extension cord was used to power a relocatable power tap on a workbench.  The relocatable power tap provided power to a stereo system, circular saw, and a heat sealer.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  On or about December 18, 2020, the employer could not verify that the required workplace hazard assessment had been performed through a written certification.  The employer could not verify that they had performed PPE assessments for employees engaged in job tasks such as disassembling truck axles, grinding, and shipping materials that addressed hazards which could affect an employee's Eyes, Head/Neck/Face, Respiratory, Hearing, Hands/Arms, Torso, and Feet.
