29 CFR 1926.102(a)(1):The employer did not ensure that each affected employee used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation: a. On or about December 22, 2020, at the west side of the residential building, two employees using pneumatic nail guns to install shingles on a 4:12 pitch roof were not wearing eye protection, exposing to eye injuries by flying debris. b. On or about December 22, 2020, at the east side of the residential building, one employee using a pneumatic nail gun to install shingles on a 4:12 pitch roof was not wearing eye protection, exposing to eye injuries by flying debris.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. On or about December 22, 2020, at the west side of the residential building, four employees performing roofing work on a 4:12 pitch roof without using a fall protection system were exposed to a 8-feet 9-inches fall hazard. b. On or about December 22, 2020, at the north side of the residential building, two employees were working in the installation of drip edge on the 2nd tier of a 4:12 pitch residential roof without using a fall protection system, exposing to a 18-feet fall hazard. c. On or about December 22, 2020, at the east side of the residential building, an employee installing roof material on a 4:12 pitch roof porch was not using a fall protection system, exposing to a 13-feet 4-inches fall hazard. Tier 1 Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1305196, citation number 1, item number 1 and was affirmed as a final order on April 30, 2018, with respect to a workplace located at 10174 Windward Way N, Jacksonville, FL 32256.
