29 CFR  1926.1053(b)(1):  Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder:   a. At a temporally jobsite located at 7212 Cypress Cove Road, building #13, in Jacksonville, FL: On or about May 3, 2024, the employer exposed employees to fall hazards, in that the employees were allowed to use a Werner ladder that the rails did not extend 3 feet above the upper landing surface of the roof at the eave and ladder was not secured at its top to a rigid support that will not deflect.  b.  At a temporally jobsite located at 7210 Cypress Cove Road, building #13, in Jacksonville, FL: On or about May 3, 2024, the employer exposed employees to fall hazards, in that the employees were allowed to use a Gopilla ladder that the rails did not extend 3 feet above the upper landing surface of the roof at the eave and ladder was not secured at its top to a rigid support that will not deflect.  c.  At a temporally jobsite located at 7208 Cypress Cove Road, building #13, in Jacksonville, FL: On or about May 3, 2024, the employer exposed employees to fall hazards, in that the employees were allowed to use a Werner ladder that the rails did not extend 3 feet above the upper landing surface of the roof at the eave and ladder was not secured at its top to a rigid support that will not deflect.

29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall:  a. At a temporally jobsite located at 7206 Cypress Cove Road, building #13, in Jacksonville, FL: On or about May 3, 2024, the employer exposed employees to fall hazards, in that the employees were allowed to carrying tools such as but not limited to: rope and hammer in their hands while climbing a ladder to access the roof level.  b) At a temporally jobsite located at 7210 Cypress Cove Road, building #13, in Jacksonville, FL: On or about May 6, 2024, the employer exposed employees to fall hazards, in that the employees were allowed to carrying roof underlayment roll in their hands while climbing a ladder to access the roof level.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):  a. Employees performing roofing work at elevations of six feet or more above the ground are not being protected from fall hazards by a fall protection system: the controlling employer Tier 1 Construction ,Inc. fails to assure effective protection against fall as required by the standard, as demonstrated on May 3, 2024, when eight (8) employees performing roofing work on a 5:12 roof pitch of a house located at Building #13 on Cypress Cove Road, units 7206 -7212, in Jacksonville, FL, were exposed to the fall hazards, in that employees did not use fall protection system.  The Tier 1 Construction was previously cited for a Repeat Serious violation of this occupational safety and health standard or its equivalent standard 29CFR 1926.501(b)(13), which was contained in OSHA inspection number 1507794, citation number 2, item number 1 and was affirmed as a final order on 08/31/2021, with respect to a workplace located at 763 Egret Bluff Ln. in Jacksonville, FL, 32211.

29 CFR  1904.41(a)(1)(i): The establishment had 20 or more employees but fewer than 250 employees at any time during the previous calendar year, and the establishment was classified in an industry listed in appendix A to subpart E of this part, and the employer did not electronically submit information from OSHA Form 300A Summary of Work-Related Injuries and Illnesses to OSHA or OSHA's designee by the specified date:   a. Tier 1 Construction, Inc., located at 13249 Atlantic Blvd, 4-212. in Jacksonville, FL 32225: On or about May 3, 2024, the employer failed for calendar year 2023, to electronically submit information from the OSHA Form 300A or equivalent by 03/02/2024. The establishment employed approximately 30 employees and was classified in the North American Industrial Classification System as 238160 during calendar year 2023.
