OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to fire hazards: At the paint booth, employees are using the metal forks of forklift to break the hardened Gelcoat material accumulated on the floor and pull it out of the paint booth.

29 CFR 1910.178(b)(12):The atmosphere or location was not classified as to whether it was hazardous or nonhazardous prior to the consideration of industrial trucks being used therein and the type of industrial truck required was not provided as in paragraph (d) of this section for such location. At the paint booth, employees were exposed to fire hazards, in that, forklifts such as, but not limited to, propane fuel forklifts are used in areas where flammable conditions are likely to be present due to the accumulation of flammable materials. The employer failed to determine the type of industrial truck appropriate for the type of atmosphere or location.
