29 CFR 1910.1053(d)(1):The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2) or the scheduled monitoring option in paragraph (d)(3) of this section: a. On or about May 15, 2025, in the Gelcoat department, the employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level. OSHA sampling revealed that an employee was exposed to crystalline silica at an 8-hour TWA of 331 µg/m3, this level exceeded the Permissible Exposure Limit for RCS OSHA-PEL of 50 µg/m3. The exposure level was derived from a sample collected over a 309-minute sampling period. Zero exposure was assumed for the 171 minute unsampled period.
