29 CFR  1926.20(b)(2):  It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On January 6, 2021 at W6890 Design Drive in Greenville, Wisconsin,  the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized fall from elevation hazards, struck-by hazards, and tripping hazards associated with using roof access/egress ladders without the side rails extended at least three feet above the roof surface, debris/equipment around the top and base of the ladders, and operating pneumatic nails guns without safety glasses.

29 CFR  1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.   On January 6, 2021 at W6890 Design Drive in Greenville, Wisconsin, employees were operating pneumatic nail guns without wearing eye protection.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access.   a)  On January 6, 2021 at W6890 Design Drive in Greenville, Wisconsin, employees were utilizing an extension ladder to access/egress an east side roof edge ten feet above surface level without the ladder side rails extended at least three feet above the roof surface.  Ladder side rails were extended eighteen inches above the roof surface.  b)  On January 6, 2021 at W6890 Design Drive in Greenville, Wisconsin, employees were utilizing an extension ladder to access/egress a west side roof edge ten feet above surface level without the ladder side rails extended at least three feet above the roof surface.  Ladder side rails were extended thirteen inches above the roof surface.

29 CFR  1926.1053(b)(9): The area around the top and bottom of ladders shall be kept clear.   a)  On January 6, 2021 at W6890 Design Drive in Greenville, Wisconsin, employees were utilizing an extension ladder to access/egress an east side roof edge with trip hazards at the base of the ladder.  Roofing material debris and/or packaging was around all sides of ladder base.  b)  On January 6, 2021 at W6890 Design Drive in Greenville, Wisconsin, an employee was utilizing an extension ladder to access/egress a north side roof edge with trip hazards at the top and base of the ladder.  Roofing material debris and equipment hose were around all sides of ladder base and roofing materials were also staged against the top of the ladder.  c)  On January 6, 2021 at W6890 Design Drive in Greenville, Wisconsin, employees were utilizing an extension ladder to access/egress a west side roof edge with trip hazards at the top of the ladder.  Roofing materials were staged against top of the ladder.

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.  On January 6, 2021 at W6890 Design Drive in Greenville, Wisconsin, employees were working on a roof surface ten feet above surface level without utilizing conventional fall protection equipment.

29 CFR  1926.503(a)(2)(iii):  The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.   On January 6, 2021 at W6890 Design Drive in Greenville, Wisconsin, the employer did not provide required fall protection safety training for employees exposed to fall hazards greater than six feet while installing roofing materials.
