29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:  (a)Kevin Hoppe Construction, Inc. at 2420 North Bakker Landing Avenue in Tea, SD 57064: On or about and at times prior to January 8, 2021,  the controlling and exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials and equipment; conducted by a competent person. An employee and subcontractor employees were permitted to work in areas where fall hazards existed without the use of a fall protection system and were not provided ladders as a safe means of access/egress from the structure under construction. This condition exposed an employee and subcontractor employees to fall hazard of approximately 14 feet.

29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a)Kevin Hoppe Construction, Inc. at 2420 North Bakker Landing Avenue in Tea, SD 57064: On or about and at times prior to January 8, 2021,  the controlling employer did not ensure subcontractor employees were protected from head injuries while working below the elevated basket of a telehandler used to lift materials to the lower roof.  This condition expose subcontractor employees to struck-by hazards.

29 CFR  1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  (a)Kevin Hoppe Construction, Inc. at 2420 North Bakker Landing Avenue in Tea, SD 57064: On or about and at times prior to January 8, 2021,  the controlling and exposing employer did not ensure an employee and subcontractors employees used appropriate fall protection when conducting framing activities on the lower roof of a commercial building under construction. This condition exposed employees to fall hazards of approximately 14 feet.

29 CFR  1926.1051(a):Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, or no ramp, runway, sloped embankment, or personnel hoist was provided:  (a)Kevin Hoppe Construction, Inc. at 2420 North Bakker Landing Avenue in Tea, SD 57064: On or about and at times prior to January 8, 2021,  the controlling and exposing employer did not ensure that an employee and subcontractor employees were protected from fall hazards in that, adequate access/egress was provided for work being conducted on the roof of a commercial building under construction. An employee and subcontractors used roof trusses and framing to climb down to the lower level of the building. This condition exposed one employee and subcontractors to fall hazards up to approximately 14 feet.
