29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them: (a)Kevin Hoppe Construction, Inc. at 27142 Park Lane Drive, Tea, SD 57064: On or about and at times prior to February 5, 2024, the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontracted employees were conducting steel roofing operations on a commercial structure without the use of a fall protection system, working above ground protruding impalement metal rods, and working with unsecured working platforms without complete railing, identified on site. This condition exposed subcontracted employees to various identified hazards on site. Kevin Hoppe Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.20(b)(2), which was contained in OSHA inspection number 1509277, citation number 1, item number 1 and was affirmed as a final order on April 6, 2024, with respect to a workplace located at 2420 North Bakker Landing Avenue, Tea, SD 57064.
